1. If I live in the City limits of Park City do I need a City Permit for my pet?

Yes. You can purchase the permit at City Hall in Park City or your local Vet. Costs start at $25.00, but are reduced if the animal is spayed or neutered and fenced. If you wish to purchase the permit at City Hall, you will need to bring proof of vaccination.

2. At what age should I get my pet vaccinated?

At 5 months cats & dogs are required by law to be vaccinated.

3. Does Park City have a leash law?

Yes. You must have your dog on a leash at all times when it is not confined to a fenced yard.

4. Can cats run at large?

Yes. However they cannot trespass, so keep in mind while your cat is wandering he probably is also trespassing onto someone else¹s property.

5. How many dogs or cats are allowed per household?

You can have 3 dogs and 3 cats per household.

6. If my pet gets out of my yard, and Code Enforcement picks it up, what happens to it?

If you have identification on your pet we will first attempt to return your pet to you. However, if you are not home we will attempt to leave a message, before taking it to the shelter:

7. Do all animal bites, or scratches have to be reported?

Yes! Keep in mind that there is no cure for rabies and there is short window of time to seek treatment. Even if you have been bitten or scratched by a neighbor's pet and the pet has been vaccinated, the bite must be reported by state law.

8. Where do I report animal abuse and animal bites?

You can report abuse, neglect and animal bites to Code Enforcement at (316) 744-2026.

9. I found a dead bat, skunk or raccoon in my back yard where my dogs were; do I need to report it?

Yes. Most cases of rabies occur in wild animals, mainly skunks, raccoons, bats and foxes. Should your pet be exposed to any of these types of wildlife, it is very important that both Code Enforcement and your Vet are notified. Code Enforcement will come and pick up the dead wildlife, so that it can be tested at no cost to you. Your Vet will probably have you bring your pet in for an immediate booster.

10. Which pets are prohibited in the City?

Any warm-blooded carnivorous, wild or exotic animal including but not limited to non-human primates, raccoons, skunks, foxes, wolves, wolf hybrids, coyote hybrids, exotic cats, or exotic cat hybrids, pit bulls, pit bull hybrids. Also any animal able to deliver or cause a poisonous bite, as well as any non-venomous snake eight (8) feet in length or longer.

11. Is it OK for my dog to stay outdoors?

If you own a dog, which you keep outdoors even for a portion of time during the day or night, you must provide proper shelter and clean potable water at all times for the animal.

Building Permits for Homeowners

1. Is a permit required for a storage shed?

Yes, but sheds of less than 200 square feet do not require a building permit. Sheds cannot be placed over easements and can only be located behind the front face of the house. There is a minimum 6 foot side yard setback. This setback may be reduced with a variance from the Board of Zoning Appeals.

2. Do garages require a building permit?

Yes, garages over 200 square feet must have a building permit. No lot can be covered more than 35% of the gross lot area (see Article 4. 102 & 103, Zoning Regulations). Garages must be set back from the rear property line 20 feet and 6 feet from any side yard. More...

3. What are the permit requirements for interior remodeling?

A building permit is only required when portions of the interior structure are to be removed. Any electrical work requiring access to the breaker panel or the running of a new service line (outlet) will require an electrical permit. A new bathroom installation will require a plumbing permit. Replacement of furnaces, heaters, air conditioning units and hot water tanks require a permit as well.

4. I want to build a deck, do I need a permit?

Porches and decks less than 30 inches in height do not require a building permit; this means that decks more than 30 inches off the ground or a patio cover needs a permit. Porches, decks and covers in the front yard exceeding the face of the farthest part of the house towards the street requires a variance to install.

5. I want to do some exterior remodeling, for what do I need a permit?

Roofing and siding of homes requires a building permit as does adding new windows, enlarging window openings and window replacement. Painting and replacement of rotten wood does not require a permit.

6. Who may get a building permit?

A homeowner may pull a building permit for any work done on their property. We do not recommend that homeowners pull their own permit if a contractor is involved. The holder of the permit is responsible for all the work.

7. I need to replace my driveway; how wide can I make it?

Maximum width of driveways is 24 feet, unless you have a three car garage.

8. What kind of material can I use for my driveway?

The driveway approach (area behind the curb to the property line) must be concrete and constructed by a licensed contractor. From the property line towards the house does not require a permit.

9. How many parking spaces can I have?

Each new home built must have parking for two cars. The minimum driveway must be 8'6" wide by 19 feet long. No homeowner may use the public right-of-way between the back of curb and the property line for parking. Parking is permitted only in driveways and no where else within 25 feet of the property line (front yard setback).

10. I want to put a fence around my backyard, do I need a permit?

Standard fencing of the backyard does not require a permit. Backyard fencing cannot exceed 6 feet in height without a variance. Permitted fence types are chainlink, wood privacy, wrought iron and picket fences in packyards. Fences may be placed on the property line. Fences at the rear of each lot may be placed upon the City's easement with the understanding that should the City or any utility company need access to the easement, the fence will be removed and any re-installation will be at the expense of the homeowner.

11. My neighbor's have a fence around their front yard do I need a permit for a fence out front?

Yes. All fencing in the front yard requires a zoning permit. All fences must be placed off the road right-of-way. If you have questions concerning the right-of-way location, you will get this information when you get your permit. Fences in the front yard cannot be over 48 inches tall. The fence must have 75% open space. Typical fences that are allowed are chain link, picket, split rail and wrought iron. To compute the required openings between pickets, take the width of a single picket times three. This is the required open space between each picket.

12. Does a swimming pool require a permit?

All pools 5,000 gallons or larger require a building permit. Pools requiring permits must have at least a 48 inch high security fence. It is reommended that for any kind of a pool a secure fence should be considered. Pools cannot be placed under electrical wires.

Erosion Control

1. If I plant grass in my yard do I need to provide Best Management Practices?

Yes. If you remove existing grass install BMP's and maintain them until grass cover is reestablished.

2. Does a homewoner have to get a permit?

Yes. A permit is issued through City Hall.

3. Do I have to be careful about the fertilizer I use?

Yes check labeling and insure it is water soluble and apply at the recommended rate.

4. If I am a developer do I need to get a permit for my development?

Yes. If the development is greater than five acres, you will need to get a permit from KDHE. Copies of the approved permit must be submitted to Park City.

5. Where can I get copies of the City's BMPs?

Contact Code Enforcement at City Hall.

6. Does the City have to obey the same rules as everyone else?

Yes.

7. If I see someone allowing erosion to enter the street, whom do I contact?

Contact Code Enforcement at 744-2026 or fill out a complaint form.

8. Why can't I blow my grass clippings into the street?

Grass clippings discharged into the street eventually end up in the storm water drainage system and from there into our streams and rivers.

Health & Safety

1. I recently purchased a vehicle which I would like to restore and I don’t have a garage to store it in, is there something I need to do to make sure I’m in compliance?

Inoperable vehicles are defined, as a vehicle which does not run, does not have a current registration, or insurance, has set for thirty (30) days. To be in compliance with City Ordinance an individual may apply for a vehicle permit at the cost of $25.00 per year. In order to meet the requirements for the permit the individual, must keep the tires inflated, free of debris, secured the vehicle to prevent entry and the vehicle covered with a fitted vehicle cover.

2. This year I’m putting in a new lawn, and would like to let it grow to a decent height before cutting for the first time, what does the Ordinance say about grass?

Grass, and weeds must be maintained before reaching 12 inches, failure to do so could result in a notice of violation, then possibility of a City Contractor mowing the grass, then a bill or citations being sent to the property owner.

3. My neighbor had a garage sale a couple of weeks ago, and has kept the furniture, and appliances outdoors since this time is there a City Ordinance against this?

Yes there is. Household items such as furniture, appliances must be stored properly, e.g. in a shed or garage. Yards should be free of clutter & debris, brush.

4. Where can I store my trash container?

Trash containers should be maintained from the front of the house, except on the day before to the day after trash pickup. Household trash must be maintained in 35 gallon containers and/or 70 to 108 gallon trash containers on wheels with attached lid. Bags should never be stored on the ground.

Housing Code

1. I recently received a letter from the Code Enforcement Department indicating that I need to paint my house, what is the purpose?

All exterior walls of homes must be maintained so that they are weather and watertight so as to prevent deterioration Paint must be consistent in color.

2. My metal shed in the backyard is starting to fall apart does the City ordinance require me to repair it?

Yes, all structures must also be maintained in good repair, including fences.

3. I’m renting a house, and would like to open my windows for fresh air, however there are no screens on the windows, is there an Ordinance that states that there has to be screens?

Yes there is. If you are using the windows as ventilation then the following applies: From April 1st to November 30th of each year all windows and doors used for ventilation must be supplied with screens, to prevent flies, insects and rodents from entering the premises.

Lawn Sprinkler Systems

1. What are the Park City requirements for operating a Lawn Irrigation System?

A permit is required for installation of a sprinkler system.

Every year a backflow technician certified by the state of Kansas must inspect the cross connection device & file a report with the City of Park City. In addition, every five years the device must be rebuilt; this entails replacement of worn parts & the O-rings which help seal the system.

State laws require annual inspection of all connected systems.

2. What is the potential hazard?

If a backflow device is not properly installed or isn’t working properly and there is a loss of water pressure, anything that is in the pipes or pooled around a sprinkler head can be siphoned back into the water supply. Contaminants, bacteria and/or lawn chemicals, can be drawn into the water supply lines to the house or even to neighboring houses.

3. What is the penalty for not getting an inspection?

If a test report is not received in a timely manner, i.e. within a year and three months of the last inspection, a reminder letter is sent. If there is no response to that notice, a second letter is sent defining the penalties for failure to comply. These penalties can result in enforcement ranging from disconnection of service to Municipal Court action.

4. Can I install or winterize my own system?

Yes, permits can be issued to the homeowner, but an inspection by a Certified Technician is still required.

5. How much does a permit cost?

Cost is $35.00 for a plumbing permit and $10.00 for the cross connection permit. These costs include the initial inspection of the system to assure that it complies with the Plumbing Code.

6. How much does an inspection cost?

The average backflow test by a Certified Technician ranges from $45 to $75. Every five years a rebuild will add about $25 to $35 to that cost.

7. What if I have well water?

There is no requirement for a backflow permit in that case, however a plumbing permit is still required. If you use your well for drinking water, you should have a backflow device on your sprinkler system.

Municipal Court

1. Who can I talk to about my case?

- Concerns about the actions of a police officer should be taken up with the Chief of Police. However, he will not comment on the validity of the ticket/charge nor will he take legal action on your behalf (such as voiding the ticket).
- The Court Clerk will be happy to explain the court's rules and procedures or give other general information that you may need. He/she cannot give legal advice nor discuss particulars of the case with persons not directly involved.
- Questions about plea bargains, reduction of charge, sentencing alternatives, etc. should be taken up with the prosecutor at the time of hearing. You may be required to set the matter for court the prosecutor will speak with you.

2. Can I speak with the Judge before my court date?

- No, it would be unethical for the judge to hear only one side of the case without the other side present.

3. Can I pay my ticket before coming to court?

- If the officer has written a fine amount on the ticket, you may pay the fine any time before the court appearance date. You may mail a check or money order or you may pay in person.

4. Can I get an extension of a court date or payment?

- By court rules a defendant is entitled to one continuance for any reason. The request should be made 7 days before the date of the hearing. Generally the hearing will be moved to the next arraignment date, although more time might be granted for exceptional circumstances.
- If you have set up a payment plan and are having difficulty making your payments you should contact the court clerk to see if other arrangements can be made.

5. Can I pay my fine in installments?

- Only the judge can authorize a payment plan and he will only do that in court. Therefore, if you want to make arrangements to pay in installments, you must appear in court first.

6. What are the administrative fees and why must I pay them?

- In addition to the fine, state and local governments have assessed different charges that are payable into separate government funds.
- By law the judge cannot waive these fees, although they will only be charged once for each incident.

7. What happens in the different court hearings?

Arraignment
For the reading of the charge and taking of a plea. If the defendant pleads guilty the judge will pass sentence or refer the matter to the court services officer for pre-sentence investigation. No evidence or testimony is given at this time. If the defendant pleads not guilty the matter will be set for trial.

Trial
A case is presented by the City and the defendant according to the rules of evidence. The judge will make a decision of guilty or not guilty based on the evidence presented and applicable laws. A brochure outlining court procedures is available from the court.

Matters Pending
These are matters that do not require a decision of guilty or not guilty. Matters include review of PSI reports, sentencing, assignment of court appointed attorneys, etc.

8. Do I need an attorney?

- This is a personal decision. Professional legal counsel will represent the City. Some traffic and criminal matters heard by the court are misdemeanors and carry possible jail time if the defendant is convicted. A defendant wishing to defend him/herself in these matters must sign a document known as a Waiver of Counsel. This will usually be done at time of plea.

9. How do I get a court appointed attorney?

You must meet the following requirements:
- The charge must carry possible jail time.
- You must show a good faith effort to obtain an attorney.
- You must fill out an Affidavit of Indigency. This is a sworn statement of your income, expenses, property and net worth.
- The judge will make his decision to appoint an attorney based on this information. When you are appointed an attorney you will be given his/her name and instructions on how to meet with him/her.

10. What happens if I miss a court date?

- The judge has the authority to issue a warrant for the arrest of any person who willfully fails to appear in court.
- Generally speaking:Failure to appear on a traffic infraction will result in a formal summons being issued and a $20 penalty added to the fine, if found guilty. Subsequent failure to appear will result in suspension of driving privileges and the issuance of an arrest warrant.
- If the defendant is under bond, the bond will be forfeited automatically and a warrant will be issued.
- Failure to appear for trial will also result in the automatic issuance of a warrant.

11. Am I allowed to attend court is I do not have a case on the docket?

- All court hearing are open to the general public and any interested persons are invited to attend. If a group of people plan to attend, such as a Scout Troop, the person in charge is encouraged to contact the court clerk beforehand so that he can ensure adequate seating etc. The judge might also be available to answer general questions about the court.

2. Do I have to recycle?

No, that is your choice, although we hope you will.

3. Do I have to pay anyway?

Yes. You will be billed $3.90 per month on your utility bill or billed separately if you don’t have City water or sewer services.

4. Why do I have to pay for something I may not use?

Park City has contracted with Stutzman Refuse Disposal to run a route of all City streets to pick up recyclables; that’s what we are all paying for.

5. How does this save me money on my trash bill?

Through the contract with Stutzman Refuse Disposal, Park City residents can pay a reduced trash rate of $11.00 per month, billed on the utility bill with the recycling fee.

6. How do I get the low rate?

For service with Stutzman, call City Hall. If you want to keep your current provider, call them to see if they will match the $11.00 rate.

7. When will the recyclables be collected?

On Tuesday every two weeks. See the Recycling Calendar for details.

8. What if Monday or Tuesday is a holiday?

Pickup day moves to Wednesday.

9. What if my recyclables are not picked up?

Call 1-800-230-0383 and SRD will pick up the next day.

10. Where do I put recycled items?

At curbside by 7:00 a.m.

11. What kind of container can I use?

A separate recycling cart will be provided.

12. How do I separate recyclables?

Park City recycling is single stream. Do not place materials in bags. Shredded paper is not accepted.

13. What other items can I recycle through this program?

Car, boat, truck batteries – place curbside with other recyclables.

Used motor oil – use plastic containers with lids (liquid soap bottles are great). Label “Motor Oil”.

14. What can't be recycled?

Residential Rental Property Permits

1. Is there a Rental Property Ordinance in Park City?

Yes. All rental homes within the city limits must be licensed by the City of Park City.

2. How do I get a Rental Property Permit?

Contact Code Enforcement to obtain a Rental Application (an application can be printed by clicking the link below). Once the application process has been completed, Code Enforcement will conduct an inspection of the home for basic safety related items. Inspections on not conducted on appearance, but on the minimum Standard Housing Code. Rental Property Application

3. What type of items are checked by Code Enforcement during the Rental Inspection?

Code Enforcement will check furnaces and water heaters. Smoke detectors must be hard wired with a battery backup. Bathrooms are checked for ventilation either by ceiling vent or window. Traps under the kitchen & bathroom sinks, as well as a a means of egress from each bedroom are also checked.

Signs

1. Where can I put up garage sale signs?

Garage sale signs may be placed temporarily in the public right-of-way with the permission of the adjacent property owner. Signs placed in the public right-of-way shall not block traffic vision or be larger than four square feet. Signs must be removed after the sale.

2. Can I put up a portable sign?

Portable signs are allowed in residential neighborhoods for a period not to exceed 72 hours; a permit costs $10.00. The signs cannot exceed 32 square feet. Signs can only be used to announce nonprofit organizations or personal and family events such as "Happy Birthday".

Zoning

No, children’s play equipment or other outdoor equipment or as dog houses should never be stored in the front yard.

2. We just lost our pet where can I place signs?

Garage sale signs, lost pet signs, etc. cannot be posted on utility poles or trees that are on the City right-of-way; the best location would be a community bulletin board such as Leekers. Garage sale signs can be placed on stakes in the ground on the city right-of-way through the duration of the sale at the sale location.
